1. Acceptance of Terms
These Terms of Service (“Terms”) govern your access to and use of the ToonSocial website, applications, features, and related services (“Services”). By accessing or using the Services, you agree to be bound by these Terms.
If you do not agree to these Terms, do not access or use the Services. Our collection and use of personal information are described in our Privacy Policy.
2. Eligibility
You must be at least 13 years old to use ToonSocial. If you are under the age of legal majority where you live, you may use the Services only with the consent and supervision of a parent or legal guardian who agrees to these Terms. You may not use the Services if applicable law prohibits you from doing so.
3. Account Registration & Security
Some features require an account. You agree to provide accurate, current, and complete information and to keep that information updated. You are responsible for safeguarding your login credentials and for activity conducted through your account.
You must promptly notify us at [email protected] if you suspect unauthorized access to your account. You may not sell, transfer, or share your account in a way that compromises the security or integrity of the Services.
4. User Conduct & Prohibited Content
You agree to use the Services lawfully and respectfully. You may not use ToonSocial to create, upload, share, promote, or facilitate content or conduct that:
- Violates any applicable law, regulation, court order, or third-party right
- Is fraudulent, deceptive, defamatory, harassing, threatening, hateful, or discriminatory
- Exploits or endangers minors, or contains sexual content involving minors
- Infringes intellectual property, privacy, publicity, or other legal rights
- Impersonates another person or misrepresents an affiliation or identity
- Promotes spam, scams, malware, unauthorized advertising, or harmful code
- Interferes with the Services, bypasses security measures, or attempts unauthorized access to accounts, systems, or data
- Uses automated means to scrape, collect, or manipulate data or engagement without our prior written permission
We may review, restrict, or remove content and take action against accounts when reasonably necessary to enforce these Terms, protect users, or comply with law.
5. User-Generated Content & License
You retain ownership of content you create and submit to ToonSocial (“User Content”). You are responsible for your User Content and represent that you have all rights necessary to submit it and grant the license below.
By submitting User Content, you grant ToonSocial a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to host, store, reproduce, format, adapt for technical delivery, distribute, display, and otherwise make that content available as needed to operate, provide, secure, improve, and promote the Services.
This license does not transfer ownership of your User Content. It continues for as long as your content remains available through the Services and for a reasonable period afterward where copies persist in backups, legal records, or content shared by other users.
6. Intellectual Property
The Services, including ToonSocial branding, software, interfaces, designs, text, graphics, and other materials provided by ToonSocial, are owned by or licensed to ToonSocial and are protected by intellectual property laws. Except for the limited right to use the Services under these Terms, no rights are granted to you. You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from the Services unless applicable law permits it or we give prior written permission.
7. Premium and Payments
ToonSocial offers optional one-time founder memberships that grant lifetime premium access. There is no recurring subscription at this time. The tier and price applicable to your purchase are shown before you buy, and prices are stated in U.S. dollars (USD) unless expressly stated otherwise.
Card payments are processed by Patreon (patreon.com), which handles payment collection, receipts, applicable taxes where required, and related payment administration under its own buyer terms and privacy policy. Crypto payments are made directly on-chain to a non-custodial address and are not handled by a third-party processor.
Founder purchases are covered by our Refund Policy. If ToonSocial introduces recurring subscriptions in the future, the applicable renewal, billing, and cancellation terms will be presented at checkout before you subscribe.
8. Termination & Suspension
You may stop using the Services at any time and may request account deletion through the available account settings or support channel. We may suspend, restrict, or terminate access to some or all of the Services if we reasonably believe you violated these Terms, created risk or harm, failed to pay applicable fees, or if action is required by law.
Where appropriate, we may provide notice and an opportunity to address the issue. Provisions that by their nature should survive termination, including ownership, licenses already granted, disclaimers, liability limits, and indemnification, will remain in effect.
9. Disclaimers
To the fullest extent permitted by applicable law, the Services are provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory. ToonSocial disclaims implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services will always be uninterrupted, secure, error-free, or free from harmful components, or that user-provided content will be accurate or reliable. Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.
10. Limitation of Liability
To the fullest extent permitted by applicable law, ToonSocial and its affiliates, officers, employees, agents, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or business opportunities arising from or related to the Services or these Terms.
To the fullest extent permitted by law, our total aggregate liability for all claims arising from or related to the Services or these Terms will not exceed the amount you paid to ToonSocial for Premium Membership during the 12 months immediately preceding the event giving rise to the claim. These limitations do not apply where liability cannot lawfully be limited or excluded.
11. Indemnification
To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless ToonSocial and its affiliates, officers, employees, agents, and service providers from claims, liabilities, damages, losses, and reasonable costs arising from your User Content, your use or misuse of the Services, your violation of these Terms, or your infringement of another person’s rights. We reserve the right to control the defense of any matter subject to indemnification, and you agree to cooperate with that defense.
12. Changes to Terms
We may update these Terms from time to time to reflect changes to the Services, business practices, or legal requirements. We will post the revised Terms on this page and update the “Last updated” date. Where required by law, we will provide additional notice of material changes. Your continued use of the Services after revised Terms take effect constitutes acceptance of those Terms.
13. Governing Law
These Terms are governed by the laws applicable in the jurisdiction where ToonSocial’s operating entity is established, without regard to conflict-of-law principles. Disputes will be submitted to courts of competent jurisdiction associated with that location, unless mandatory consumer protection law gives you the right to bring a claim in another jurisdiction.
